1. Free Messages: Users will be provided with five free messages upon sending a message on WhatsApp to Thelio. After the initial ten messages, users will be required to subscribe to a monthly plan in order to continue using the service.

2. Subscription: Monthly subscriptions will automatically renew unless canceled by the user. Cancellation of a subscription can be done at any time by the user.

3. Refunds: ThelioAi does not offer refunds for active subscriptions.

4. Google Gemini Pro & ChatGPT 3.5 & 4: ThelioAi is not responsible for fact-checking any responses provided by Google Gemini Pro & ChatGPT 3.5 & 4. Users are responsible for using the information provided by Google Gemini Pro & ChatGPT 3.5 & 4 at their own risk.

5. Downtime: ThelioAi is not responsible for any downtimes that the OpenAI ChatGPT 3.5 & 4 or Google Gemini Pro API service's may have. Users understand that there may be times when the service is not available due to OpenAI or Google downtime. Such downtime will not warrant a refund.

6. Usage: In the Thelio Plus subscription plan, users have unlimited monthly messages in all the five features.

7. Warranties & Responsibility: ThelioAi makes no warranties or representations about the services or products provided. The user assumes all responsibility and risk for the use of ThelioAi.

8. Intellectual Property: ThelioAi owns all rights, including intellectual property rights, in the website and its content. Copying or reproducing any part of the website without written consent from ThelioAi is prohibited.

9. Account Suspension/Cancellation: ThelioAi reserves the right to suspend or cancel a user's account at any time, for any reason.

10. Indemnification: The user agrees to indemnify and hold ThelioAi, its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of user's use of ThelioAi, the violation of these Terms of Service, or infringement of any intellectual property or other right of any person or entity.

11. Limitation of Liability: ThelioAi shall not be liable for any damages whatsoever, including but not limited to any direct, indirect, special, incidental, or consequential damages, arising out of or in connection with the use or inability to use ThelioAi or any part thereof.

12. Preference of Law and Dispute Resolution: These terms of service shall be governed by and construed in accordance with the laws of United Kingdom without giving effect to any principles of conflicts of law.
